Fresenius Medical Care is one such company. They did nothing even after data collected from their hemodialysis centers revealed that more than 900 patients experienced cardiac arrest when treated with their product in 2010. Instead of alerting all doctors and medical centers of dosing problems, they circulated a November 2011 memo among their clinics only that stated “the issue needs to be addressed urgently.” They notified non-Fresenius clinics and made a voluntary label change in March 2012 to reflect new dosing standards.

However, these adjustments were much too late for grieving families and the many innocent victims who had already died following dialysis treatment with Fresenius products. A third of all dialysis patients are treated with GranuFlo & NaturaLyte

Roughly a third of the 400,000 Americans on dialysis are treated with GranuFlo and NaturaLyte, including 125,000 patients in clinics not owned directly by Fresenius Medical Care. These patients were all uninformed of the risks associated with the product because the company felt their research “was not in a condition for general consumption.”

Dialysis treatment is administered when a person’s kidneys can no longer clear toxins from the blood. Doctors neutralize acid that mounts in the bloodstream with an alkaline bicarbonate substance. Although GranuFlo itself does not contain bicarbonate, the body converts the product’s sodium acetate into bicarbonate once it enters the bloodstream.

The NY Times reported that GranuFlo powder and NaturaLyte liquid contain higher percentages of sodium acetate compared to similar products. Therefore, treatment providers must adjust the types and amounts of other products used in dialysis; otherwise, a potentially life-threatening condition called “metabolic alkalosis” will occur, causing a chain reaction of adverse events in the body.

NaturaLyte & GranuFlo injuries

With too much bicarbonate base in the blood and not enough acid, potassium, blood pressure and blood oxygen levels automatically drop to dangerously low levels and blood carbon dioxide levels increase.

Early physical symptoms of metabolic alkalosis include:

  • Nausea
  • Numbness
  • Muscle twitching, prolonged spasms and hand tremors

Unless treated immediately, severe symptoms can develop, such as:

  • Dizziness
  • Confusion
  • Difficulty breathing

These symptoms can lead to shock, coma, cardiac arrest, or death.

An internal memo circulated among Fresenius clinics acknowledged that 941 patients had experienced cardiac arrest following their dialysis treatment in 2010 alone. According to the memo, patients who experienced metabolic alkalosis had a “six to eightfold greater risk of cardiopulmonary arrest and sudden cardiac death in the dialysis facility.”

GranuFlo & NaturaLyte recall leads to lawsuits

In June 2012, the federal Food and Drug Administration (FDA) announced a Class I GranuFlo and NaturaLyte recall once the damning Fresenius memo went public.

In their official warning, the FDA said that the use of these products increased the likelihood of heart arrhythmia, low blood pressure, heart attack, and death. They recommended that doctors monitor pre-dialysis serum bicarbonate levels closely, review the dialysate acid concentrate labeling before prescribing additional components, be aware that ingredient levels vary by product and manufacturer, and discuss lab results with patients.

Since the recall was announced, the number of federally filed GranuFlo lawsuits has skyrocketed. Back in March 2014, there were 650 lawsuits consolidated under MDL (multidistrict litigation) #2428. One month later, there were 1,570 lawsuits in the U.S. District Court of Massachusetts under Judge Douglas P. Woodlock.

More recently, the MDL has reached 1,942 pending lawsuits as of July 15, 2014.

  • Emma Hernandez of TX, whose husband died just two days after GranuFlo treatment in January 2011.
  • Carlos and Silvia Duarte of CA, who filed after Silvia suffered a non-fatal, but disabling, heart attack in 2011.

GranuFlo lawsuit status

Bellwether trials were selected on March 28, 2014. According to Case Management Order 11, the first two trials slated for January 11 and February 16, 2016 to allow sufficient time for the extensive discovery, disposition, and rebuttal processes.

Once these early trials have been before a jury, Fresenius Medical Care may decide to offer to settle with victims outside court or they may decide to fight each of the thousands of cases individually in the courts where they were originally filed.
