Traumatic brain injury (TBI) is a serious public health problem in this country, with TBI causing a significant number of deaths and permanent disabilities every year, according to the Centers for Disease Control (CDC). In this year alone, approximately 1.7 million people will suffer a traumatic brain injury, and some 52,000 of them will die from TBI.

For those who do survive a traumatic brain injury, life is rarely ever the same again. The usually permanent, often devastating effects of a TBI can mean literally thousands or hundreds of thousands of dollars in medical and therapeutic expenses and lost work, not to mention debilitating psychosocial scars that leave a patient more vulnerable to other health risks.

A recently published study in the journal JAMA Psychiatry, for instance, finds that people who suffer from TBI are three more times likely to die prematurely (before the age of 56).

Traumatic brain injury: types, causes and symptoms

TBI results from a bump, blow, jolt or penetration to the head that disrupts the normal function of the brain. This term does not include dysfunction caused by congenital or degenerative disorders, birth trauma or injuries caused by other circumstances.

Not all blows or jolts to the head result in TBI. Some TBI’s can be classified as “mild,” only briefly changing mental status or consciousness, while others are “severe,” causing an extended period of unconsciousness or amnesia.

Traumatic brain injury can happen as a result of:

  • Car and other vehicular accidents
  • Assaults or other physical abuse
  • Construction accidents
  • Sports games
  • Diving accidents
  • Surgeries
  • Falls

If you have sustained a TBI, the following are symptoms to watch for that may also impede your quality of life and deserve compensation:

  • Weakness or numbness in fingers and/or toes
  • Loss of consciousness for several minutes to hours
  • Loss of coordination or vertigo and imbalance issues
  • Convulsions or seizures
  • Dilated pupils
  • Profound confusion or memory loss
  • Persistent fogginess or dizziness
  • Pressure on the skull
  • Headaches
  • Attention deficit or difficulty concentrating
  • Speech or hearing impairment
  • Mood changes, such as anxiety and depression, agitation, combativeness, or other uncharacteristic behaviors

Traumatic brain injury liability issues and litigation

If you have suffered a brain injury, one or more responsible parties may be held liable for damages you have endured.

In many cases, victims of brain injury can receive compensation for pain and suffering, past and present medical bills and expenses, future rehabilitation and/or occupational therapy costs, lost wages, reduced earning capacity, loss of society and consortium with family and friends, and overall diminished quality of life.

There are a host of often hidden costs that may be easy to overlook but quickly add up in caring for a patient with TBI, among them:

  • Home modifications
  • Service coordination
  • Assistive technology
  • Cognitive therapy
  • Neuropsychological services
  • Pharmaceuticals
  • Physical, Occupational and Speech Therapies
